In a turn of events that could be straight out of a cartoon strip, Sailormen, Inc., the franchise operator of Popeyeās Chicken & Biscuits in Orange City, Florida, has agreed to conciliate a federal charge after being accused of violating the Pregnant Workers Fairness Act (PWFA) and Title VII of the Civil Rights Act of 1964. The U.S. Equal Employment Opportunity Commission (EEOC) brought the charge after an incident where a pregnant employee was allegedly terminated because Sailormen, Inc. anticipated that she would need accommodations to perform her duties.
Much like Popeye regrettably handing over his spinach to Olive Oyl, Sailormen, Inc. learned that the law doesn’t discriminate, especially when it comes to providing reasonable accommodations for pregnancy. According to the EEOC, firing an employee based on the assumption that they would require such accommodations is not only unfairāitās illegal.
As part of the conciliation agreement, Sailormen, Inc. agreed to compensate the former employee, offer mandatory training to staff on pregnancy discrimination, appoint an EEO coordinator to ensure the companyās policies comply with the PWFA, and report any discrimination complaints annually to the EEOC.
Kristen Foslid, EEOC Regional Attorney, emphasized the importance of the PWFA: āThe law ensures that pregnant workers have the accommodations they need to work while maintaining a healthy pregnancy. We applaud Sailormenās steps toward reforming their policies.ā
Miami District Director Evangeline Hawthorne also acknowledged the franchiseeās willingness to resolve the issue, stating, āPregnancy discrimination remains all too common, and this case highlights the importance of properly training managers on their legal obligations to workers affected by pregnancy.ā
While this situation is serious, imagine Popeye himself handing over the cashālooking a bit crestfallenāwhile a glowing Olive Oyl happily accepts, belly full of spinach and pride. It’s a humorous visualization of the very real consequence of not respecting the rights of pregnant employees in the workplace.
